Terms and Conditions of Hire
Our terms and conditions of hire are as below. Please contact us should you require any clarification.
Definitions
“Company” means Ascend Marquees & Event Hire.
“Client” means the person, company or organisation hiring the Equipment.
“Equipment” means all marquees, structures, flooring, lighting, furniture, heating and associated items supplied by the Company.
“Delivery Date”, “Deposit”, “Price”, “Site” and “User Period” shall have the meanings set out in the Quotation.
“Period of Hire” means the period from the Delivery Date until the Equipment has been dismantled and removed from the Site.
“Quotation” means the written quotation issued by the Company to the Client.
These conditions apply to all orders and contracts for the supply of Equipment in the UK by the Company. Any variations must be agreed in writing.
All orders shall be deemed to be an offer by the Client to hire Equipment in accordance with these conditions and the Quotation.
Conditions of Hire
The Company’s quotation is made on the assumption that the Site on which the Equipment is to be erected or delivered is:
Flat, level and firm ground with suitable access for delivery vehicles; and
Free from drain pipes, cables or other services buried beneath the surface or otherwise concealed.
the Site not comply with these requirements, the Company may at its discretion either rescind the contract by verbal or written notice or apply additional charges. The Company shall not be liable for any loss, damage or expense resulting from such rescission.
The Client shall take all reasonable measures to keep the Company’s Equipment secure, closed and dry during the Period of Hire.
The Client shall not tamper with, alter, or affix anything to the structure or Equipment without prior written consent of the Company.
The Client shall not use any lighting, heating, cooking or other gas or electrical appliances inside the marquee without prior written consent of the Company.
Liability
The Company shall not be liable for:
Unsuitable site conditions
Adverse wind or weather conditions
Loss or damage caused by fire or flood
Lock-outs or strikes
Any cause beyond the Company’s control
Incorrect positioning instructions provided by the Client
Nothing in these terms excludes liability for death or personal injury caused by negligence of the Company.The Client shall provide a plan showing the position in which the Equipment is to be erected or have a representative present on site for that purpose.
If no representative is present, the Company may erect the Equipment where it considers suitable and shall be deemed to have fulfilled the contract.
Any wasted journeys due to lack of access or absent representatives may be chargeable.
Deliveries left at unattended premises are left at the Client’s risk.
Variation of Hire Charges
The Company reserves the right to vary the quoted hire charges in the event of additional work being required due to incorrect site information, restricted access, or changes requested by the Client.
Payment
A 40% non-refundable deposit is required to secure the booking.
The remaining balance is due no later than 14 days before the Installation Date.
Where bookings are made within 14 days of installation, full payment is required at the time of booking.
The Company reserves the right to charge interest (at a rate of 4% above the base rate of National Westminster Bank Plc) on all monies outstanding 14 days after the due date, both before and after judgement.
Where the Client is a limited company, the directors may be held personally liable for any outstanding sums due.
In the event of non-payment, the Company reserves the right to recover reasonable legal and debt recovery costs.
Loss or Damage
The Client shall be responsible for and shall reimburse the Company for any loss of or damage to all hired Equipment whatsoever the cause (other than fair wear and tear) unless the damage or loss is due to the negligence of the Company.
Equipment remains the property of the Company at all times.
The Client is responsible for the safe custody of the Equipment from installation until dismantling and collection.
Damage, loss, theft or excessive soiling will be charged in full.
The Client must notify the Company of any issues or discrepancies before use of the Equipment.
Liability to Third Parties
The Company shall not be responsible for injury to persons or damage to property unless it is proven that such injury or damage was caused by defective materials, workmanship, or negligence on the part of the Company.
Permits
The Client is responsible for obtaining any necessary permits, permissions or licences from any relevant authority including (but not limited to) local councils, planning authorities, police or fire services.
Any costs incurred due to failure to obtain such permissions shall be payable by the Client.
Force Majeure
While every effort will be made by the Company to carry out any order accepted, full performance is subject to variation or cancellation due to acts of God, extreme weather, war, strikes, riots, lock-outs, fire, flood, government restrictions, shortage of materials or transport, or any other cause beyond the control of the Company.
Cancellation or Premature Termination of Contract
In the event of the Client cancelling the hire after an order has been placed, the Company has the right to charge cancellation fees as follows:
More than 30 calendar days notice – 25% total hire charge, or deposit paid, whichever is the greater.
14–30 calendar days notice – 50% total hire charge, or deposit paid, whichever is the greater.
Less than 14 calendar days notice – 100% total hire charge, or deposit paid, whichever is the greater.
Electrical Supply
The Client is responsible for ensuring that the venue has sufficient power supply, plug points and connectors for any lighting, heating or other electrical equipment hired.
